From 24 August 2022, all translations of procedural acts in English must be certified by a certified translator in Canada. This amendement was proposed by the OTTIAQ (l'Ordre des traducteurs, terminologues et interprètes agréés du Québec).

What does this amendment say?

The Canadian government has adopted a new amendment whereby all procedural acts in English shall include a translation made by a certified translator in Canada. This amendment, proposed by the OTTIAQ, was adopted on 24 May.

According to the Article 9 of the Charter: "A French translation made by a certified translator must be attached to any legal document in English issued by a legal person. The costs of translation shall be borne by the legal person." This new measure takes effect in three months, i.e., on 24 August 2022.

Canada is devoted to its certified translators, giving them the exclusive right to certify a translation of procedural acts. This will prevent such translations from being carried out by unqualified people.

Several institutions had already implemented this policy, such as the Ministry of Immigration, Francisation and Integration of Quebec, the Ministry of Education, the Quebec Automobile Insurance Corporation (SAAQ), the Health Insurance Board of Quebec (RAMQ), the Director of Civil Status, the University of Montreal, McGill University, etc.

What is a certified translator in Canada?

A certified translator is a trustworthy member of a professional association of translators in Canada or abroad, whose certification can be confirmed by a seal or stamp bearing his/her membership number.

It means that if you require a translation done in Canada, you must use the services of a certified translator who is a member of the professional association in his/her province or territory.

If the translation is done abroad, the applicant must use the services of a certified translator (officially recognised or authorised) in the country where the translation is done.
